Terms of Service
Last updated: July 26, 2026
These terms are an agreement between you and ClaimOtter. By creating an account or using the service, you agree to them. They are written to be read — if anything is unclear, ask us before you rely on it.
1. What ClaimOtter is — and is not
ClaimOtter is not a law firm and does not provide legal advice.
ClaimOtter is a documentation platform. It helps you store and organize your claim records, measures how complete your documentation is, and helps you prepare your own complaint or response — in your own words, submitted by you, under your own name. ClaimOtter does not represent you before any insurer, regulator, or court, does not negotiate for you, and does not evaluate whether your claim should succeed. Using ClaimOtter does not create an attorney-client relationship.
2. Eligibility and your account
You must be at least 18 and using the service for your own insurance claim. You are responsible for keeping your sign-in credentials private and for what happens under your account. Tell us promptly if you believe your account has been accessed without your permission.
3. Your content
The documents you upload and the information you enter remain yours. You give us a limited license to store, back up, display, and process that content solely to operate the service for you — including the AI-assisted features described in these terms and in the Privacy Policy. You confirm that you have the right to upload what you upload.
4. Drafting assistance and your review
When you use a drafting feature, software prepares a draft from the information you provided. Every draft is presented to you for review; you edit and approve it before it is saved or used. What you submit to an insurer or regulator is your statement, prepared by you — you are responsible for confirming that it is accurate and complete before you send it.
5. The File Completeness Score
The File Completeness Score measures one thing: how complete your documentation is. It does not assess the merits of your claim, and it does not predict how any insurer or regulator will respond. A complete file is a better-organized file — nothing more is claimed.
6. Acceptable use
You agree not to:
- upload content you do not have the right to share, or content that is unlawful or infringes someone else's rights;
- submit information you know to be false;
- use the service to prepare filings for other people;
- probe, overload, or interfere with the service or other users' data; or
- resell or white-label the service without a written agreement with us.
7. Fees and subscriptions
Paid plans are not yet available for purchase.
Some features require a paid plan. Prices are shown before you pay, billing is handled by Stripe, and subscriptions renew automatically until you cancel. You can cancel at any time; your plan then runs through the end of the period you already paid for. Where a refund is required by law, we provide it.
Pro includes email support: we aim to reply within 1 business day (Monday to Friday, US Central time, excluding US federal holidays) to questions about using ClaimOtter. Support covers how the product works only. We do not give advice on anyone's claim, and ClaimOtter is not a law firm. The reply time is a goal, and if we miss it your only remedy is to cancel your plan.
8. The service is provided as is
We work to keep ClaimOtter available and accurate, but the service is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no promises about the outcome of any claim, complaint, or dispute — outcomes depend on facts and decision-makers outside our control.
9. Limits on our liability
To the fullest extent permitted by law, ClaimOtter and the people who build it are not liable for indirect, incidental, special, or consequential damages, or for loss of data, revenue, or opportunity, arising from your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim. Some jurisdictions do not allow certain limits, so parts of this section may not apply to you.
10. Ending the relationship
You can stop using ClaimOtter and request account deletion at any time. We may suspend or close accounts that break these terms, after notice where practical. If your account closes, the Privacy Policy's retention and deletion rules govern what happens to your data.
11. Changes to the service or these terms
The product will evolve. If we make a material change to these terms, we will update the date above and notify you in the app or by email before the change applies to you. Continuing to use the service after that notice means you accept the updated terms.
12. Governing law
These terms are governed by the laws of the State of Illinois, without regard to its conflict-of-law rules. Before any formal proceeding, you agree to contact us first so we can try to resolve the issue directly.
